Class Certified on behalf of Lowe’s Installers In Massachusetts
Block & Leviton filed suit on behalf of workers who install kitchens and bathrooms for Lowe's Home Centers, Inc. ("Lowe's") contending that they are improperly misclassified as independent contractors rather than as employees under Massachusetts law.
The Suffolk County Superior Court in Massachusetts granted a motion to certify a class of all installers who have been misclassified by Lowe's. Under Massachusetts law, class members are entitled to receive treble damages if they prevail in the action for all unpaid wages, taxes, and the value of benefits that they should have otherwise received.
Block & Leviton has filed similar suits against Lowe's and The Home Depot in several other states.
